Terms of Service

1. Who we are

The Patifot service is operated by PATIFOT, a French société par actions simplifiée unipersonnelle (SASU) with share capital of €30,000, registered with the Paris Trade and Companies Register under number 983 410 473, with its registered office at 58 rue de Monceau, CS 48756, 75008 Paris, France ("Patifot", "we"). 2. What the service is

Patifot is a platform for professional photo booth operators. It consists of an iPad application that runs the booth ("App") and a web dashboard for preparing and monitoring events ("Dashboard", together the "Service"). "Operator" or "you" means the business customer holding the account. "Event" means an occasion configured in the Dashboard. "Guest" means a person photographed at a booth during an Event.

The Service is intended for business use. By creating an account you confirm that you act in the course of a trade or profession and not as a consumer.

3. Accounts and early access

During early access, accounts are created by us on request. You must provide accurate information about your business and keep it up to date. You are responsible for the actions of the people you give access to, and for keeping credentials confidential.

Early-access features may change or be withdrawn as the product develops. Where a change materially reduces what you have paid for, we tell you in advance and Section 12 (termination) applies.

4. Devices and licenses

Each booth iPad is activated with a device license managed in the Dashboard. Licenses are bound to devices. The number of active devices under your account may be limited by your plan.

5. Subscription, credits and payment

No public subscription or credit offer is available yet. Early-access use is governed by the written order or pilot agreement provided directly by Patifot. The final commercial offer will state renewal, included concurrent booth seats, additional-seat terms and the credit catalog before any checkout opens.

When AI credits are activated, their use, balance and event-continuity rules will be shown in the applicable order and on the pricing page. Credits are not legal tender and have no cash value except where the applicable refund policy or mandatory law says otherwise.

When credit checkout is enabled, Paddle will act as merchant of record and handle applicable taxes and invoices. Subscription checkout remains unavailable until a server-issued purchase flow is released.

6. Your obligations

You agree to:

  • use the Service only for lawful events and comply with the laws that apply to you, including data protection law and any venue rules;
  • determine and document the lawful basis for Guest data, provide any additional notices or permissions required by your jurisdiction, and keep the mandatory Patifot processing notice and Start action visible at the booth;
  • configure AI prompts that are lawful and appropriate for your audience, and review the style in the sandbox before the Event;
  • not resell, sublicense or make the Service available to third parties except by operating booths for your own clients;
  • not reverse engineer the App, probe the Service for vulnerabilities, or use it to build a competing product.

7. Guest photos and data protection

For photos and related Guest data processed through the Service, you are the data controller and Patifot acts as your processor. Our processing commitments, retention windows and the list of subprocessors are described in the Privacy Policy. A reviewed data processing agreement must be signed before an operator processes real guest photos through the Service.

You are responsible for ensuring that, in every country or region where you use the Service, you own or have all permissions needed to use the photos taken at your Events and the frames and other assets you upload, and to authorize Patifot to host, process, transform (including AI styling) and deliver them. You grant us that license solely to provide the Service.

8. AI output

AI-styled photos are generated by machine learning models and can be inaccurate, unexpected or unflattering. You are responsible for choosing and testing the style you offer to Guests. We may block prompts or generations that violate the law or the policies of the enabled providers listed in the Privacy Policy. The current primary route is OpenAI; xAI remains disabled unless separately approved and disclosed.

9. Intellectual property

The Service, including the App, the Dashboard and everything behind them, belongs to Patifot or its licensors. These terms grant you a limited, non-exclusive, non-transferable right to use the Service for your business while the applicable order or pilot agreement remains active. If you send us feedback, we may use it without obligation.

10. Availability and support

We design the Service so that classic photo modes work offline and a booth keeps operating through network failures. We do not promise uninterrupted availability of the online parts of the Service and offer no service level agreement during early access. Support is provided by email at [email protected].

11. Liability

To the extent permitted by law, our total liability for all claims arising out of the Service in any 12-month period is limited to the amounts you paid us for the Service during that period. We are not liable for indirect or consequential losses, including lost profits, lost business or reputational harm. Nothing in these terms excludes liability that cannot be excluded under French law, including for gross negligence, willful misconduct, death or personal injury.

12. Suspension and termination

You can stop using the Service at any time. Any cancellation date and paid-period effect are governed by your written order until the public subscription offer launches. We may suspend or terminate your account if you materially breach these terms and do not cure the breach within 15 days of notice, or immediately where the breach is serious (unlawful use, non-payment, security abuse). Upon termination we delete your data in accordance with the Privacy Policy.

13. Changes to these terms

We may update these terms as the Service evolves. For material changes we give at least 30 days' notice by email. If you do not accept a change, you may terminate before it takes effect and we refund any prepaid period after the termination date.

14. Governing law and jurisdiction

These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the competent courts of Paris, France.
